These Terms of Service (“Terms”) govern your access to trickplay.games and any game, website, or service from Trick Play Games that links to these Terms (collectively, the “Services”). By using a Service, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility

You must be legally able to agree to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms on your behalf.

License to use the Services

Subject to these Terms and any additional rules shown in a game or storefront, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial entertainment. You do not receive ownership of the Services or any content in them.

Acceptable use

You may not:

• break the law or infringe another person’s rights;
• interfere with, disrupt, damage, or gain unauthorized access to a Service;
• use cheats, bots, exploits, automation, or unauthorized software;
• harass others or submit unlawful, deceptive, or harmful content;
• reverse engineer or modify a Service except where law expressly permits it; or

Purchases and virtual items

Purchases may be processed by a third-party storefront and are also subject to that storefront’s terms and refund rules. Unless applicable law or the storefront requires otherwise, digital content and virtual items are licensed, not sold; have no cash value; and may not be sold, transferred, or exchanged outside authorized features. Features, balances, and virtual items may change as a Service evolves.

Intellectual property

The Services—including software, artwork, audio, characters, designs, text, logos, and other content—are owned by Trick Play Games or its licensors and are protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.

Third-party services

A Service may depend on or link to third-party platforms, storefronts, networks, or content. We do not control those services, and your use of them is governed by their terms. Their availability may affect our Services.

Updates and availability

We may update, modify, suspend, or discontinue all or part of a Service. We do not guarantee that any Service or feature will always be available, uninterrupted, secure, or error-free.

Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms limits rights that cannot lawfully be waived.

Limitation of liability

To the fullest extent permitted by law, Trick Play Games and its owners, team members, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from or related to the Services. Where liability cannot be excluded, it will be limited to the greater of the amount you paid us for the affected Service during the six months before the claim or US $50. These limits do not apply where prohibited by law.

Changes to these Terms

We may update these Terms as our Services or legal obligations change. We will post the revised Terms here and update the date above. Continued use after an update means you accept the revised Terms to the extent permitted by law.
